Singer of Tokio Hotel suing against Ad Campagne

The vocalist of the group Tokio Hotel has brought an action against the newspaper «Leipziger Volkszeitung» in connection with one of its advertising campaigns. The higher regional court of Dresden was informed of this on Friday. In June of last year the newspaper printed Bill Kaulitz’s photo with the signature «Non-Stop to Superstars».

With it a project of an urban music school was being advertised, which helps musical fans to create a band and thus facilitates the road to rock stars. The first complaint of the singer for compensation of 15,000 euros had been rejected by the district court.

well, if he is suing, the opponent must have done something really bad and wrong…

hes suing because they used his picture without his permission and payment, so he wants his money and his named ceared because it made it look like he was supporting that music school, when he probably wasn’t. i would probably do the same thing :)GO BILL!!!!!!!!!!!!!!!!

I dont really understand what the big deal is, I mean his pictures are everywhere :S

yeah, thats what I thought.
you see his pictures in so many magazines,
so why would this be any different. I guess
it makes more sense that since it was an
advertisment he should have been told about
it and payed.

No it’s because he was laegidly supporting a music thingy that he wasn’t and so the newspaper was using him for advertising wen they didn’t hv the right to they need a contract like with the nokia thingy

and i think if they use your pic without permission you dont get paid for it or anything either and its a copyrighted picture so its illegal for them to use it.

So he is suing a music school for using his name? As it is a comersal campain they should not use his image without asking for it. And if it is a commersal product the school gets payed by the student, so the school should pay Bill!!!! And Bill should give the money to charety for young people who wants to become musicians.
I want to see the ad to make up my mind about this whole thing…. If it’s just a small pics saying Bill once went to a music school it shouldn’t be a problem, should it????? Or….

And Bill’s name wasn’t posted just his image, but they still tried to draw in revenue using his image. That’s not right

it’s like he’s part of the compaign while they didn’t even asked for permission
he already participated in a similar compaign for a new musical school, so the problem here is them using him for benefits

I think he is suing cuase they used his name and image for a school he has nothing to do with,They use him like a comersial for their school.When you see his face there,you’ll imediately think-wow,Bill Kaulitz learned in that school ,he is so succsesfull,we should go there as well.

They have been trying for sometime to charge the stalkers.

But a case where you have to first gather a lot of evidence takes much longer. Getting pictures, trying to figure out if they can prove the people with scarves over their faces are the afghans on tour, speaking to fans who witnessed the afghans stalking, and so on.
So that’s could be the delay.

They are making money off his image.
You have to get someone to sign a “model release” to use their image. Unless they are in a crowd/at a public event, you’re suppose to obtain permission.

However, with celebs it’s free game as you have agreed to be a public figure. It can still be argued but is more difficult.

This person however is actually making money off of Bill’s photo, because he used his image to draw in customers.

He may not win in court, but by bringing negative attention to the music school Bill may loose the battle but win the war so to speak.

Yes that’s exactly it.

Of course he should be supporting something like this BUT he has to give express authorization first, ’cause like you said… the school is getting money out of it by using Bill’s image to attract people so Bill should receive part of this money.

Also, just because it’s a music school, doesn’t neccessarily mean they are a good school or one Bill would want to lend his name to.

I’m sure Bill would want to know if a school was well run, hired good staff, good rep., etc. before agreeing to help them advertise.
But again the point of the law suit is: if you’re making money off of someone you have to get their permission first.

especially that there is a commercial part of the thing, I red that they made a discount for those who would attend the scool and will subscribe to their newspaper
it’s not because he’s a public face that they can use him to get more clients

When I first read this, it was a bit confusing and it sounded a little messed. But now I understand. They should have just asked permission first. If it was for a genuinely good cause, he would have gladly said yes.

not being a total geek or anything..but you see… the ad wasn’t something he had approved on.

His photo is HIS copyright, and using it in any form of advertising, distribution, etc. without the consent of the artist is ILLEGAL.

I must say that the amount that was asked IS a bit too much, but you see, this magazine infringed his copyright.

If you still don’t get it; it’s like getting your videos down on YouTube..or any other video site.

Lots of law suits going on with this band.
But I always find after bad luck follows good luck, and Tokio Hotel are long over due for a shxt load of good luck.
